Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and StartupRoastAI ("Company," "we," "us," or "our") governing your access to and use of the website at startuproastai.com and all related services, features, content, and functionality (collectively, the "Service").

By accessing or using the Service, creating an account, or clicking "Agree" where this option is presented to you, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

StartupRoastAI is an AI-powered landing page analysis platform that provides feedback, scoring, and improvement suggestions for websites and landing pages submitted by users. The Service uses artificial intelligence and machine learning technologies to evaluate design, copywriting, conversion optimization, user experience, SEO, and trust signals.

The Service offers two tiers:

• Free Plan: Limited monthly credits, analysis of up to 3 websites, basic improvement suggestions.
• Pro Plan: Expanded credits, unlimited websites, all improvement suggestions, screenshot analysis, full-site crawl, PDF export, and detailed analytics.

We reserve the right to modify, suspend, or discontinue the Service or any part thereof at any time, with or without notice, and we will not be liable for any such modification, suspension, or discontinuation.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate, current, and complete.
• Maintain the security and confidentiality of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breach or unauthorized use of your account.
• Be at least 13 years of age (or 16 in the EEA) to use the Service.
• Not create an account if you have previously been banned from the Service.

You are responsible for all activity that occurs under your account. We reserve the right to terminate accounts that are found to have provided inaccurate or misleading registration information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to analyze websites you do not own or do not have explicit permission to analyze.
• Use the Service in any way that violates applicable local, national, or international laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks.
• Use automated means (bots, scrapers, crawlers) to access or use the Service beyond normal usage patterns.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
• Circumvent, disable, or otherwise interfere with security-related features of the Service.
• Use the Service to submit malicious URLs, phishing pages, or content that is illegal, harmful, or offensive.
• Share, sell, or transfer your account credentials to any third party.
• Submit URLs containing personally identifiable information of individuals without their consent.
• Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
• Attempt to manipulate or game the scoring or leaderboard systems.

We reserve the right to terminate your access to the Service immediately, without notice, if we determine that you have violated these Terms or engaged in conduct that we deem harmful to the Service, other users, or third parties.

StartupRoastAI uses artificial intelligence to generate analysis reports, scores, and suggestions. You acknowledge and agree that:

• AI-generated analysis is subjective and may not always reflect best practices in every industry or context.
• Scores and suggestions are intended as guidance only and should not be treated as definitive professional advice.
• The AI may make errors, omissions, or assessments that do not apply to your specific business, audience, or market.
• Results may vary between analyses of the same URL due to AI model variability.
• We do not guarantee that following our suggestions will result in any specific business outcome, conversion rate improvement, or revenue increase.

We strongly recommend treating our analysis as one data point among many and combining it with your own judgment, user research, and professional advice where appropriate.

The Service integrates with and relies on third-party services, including OpenAI, PayPal, Supabase, Vercel, and others. These services are subject to their own terms of service and privacy policies. We are not responsible for the practices, availability, or actions of these third parties.

In particular, our AI analysis is powered by OpenAI's API. By using the Service, you agree that page content from submitted URLs may be processed by OpenAI pursuant to OpenAI's Terms of Use.

By default, your roast results may be set to public, which means they can appear on our public leaderboard and be accessed by anyone with the share link. You can change the visibility of any roast to private at any time from your dashboard.

For public roasts, you grant StartupRoastAI a non-exclusive, worldwide, royalty-free license to display the URL, score, and tier label on our leaderboard and in promotional materials (such as social media showcasing top-scoring pages).

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results or analysis obtained from using the Service will be accurate, reliable, or applicable to your situation; (c) any errors in the Service will be corrected; or (d) the Service will meet your specific requirements or expectations.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STARTUPROASTAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY AI-GENERATED ANALYSIS, SCORE, OR SUGGESTION; (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRIOR TO THE CLAIM, OR (b) USD $50.00.

You agree to defend, indemnify, and hold harmless StartupRoastAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service in a manner not authorized by these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your violation of any applicable law or regulation.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration or the courts of competent jurisdiction, depending on your location and applicable mandatory consumer protection laws.

If you are an EU consumer, you may also have the right to submit disputes to your local consumer protection authority and have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• Any active Pro subscription will be cancelled and you will not receive a refund for the remaining subscription period, unless required by law.
• Purchased credits are forfeited upon account termination for cause.
• You may request an export of your roast data within 30 days of termination by contacting us.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. All provisions of these Terms which by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date and, for significant changes, by sending an email notification to the address associated with your account.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
